Terms

Terms of service.

The rules for using TwoWay, in plain language. By creating an account or using the apps, you agree to them.

Who provides TwoWay

TwoWay is operated by Marcos Montalvo (“we”, “us”). These terms apply to the TwoWay apps for Mac, iPhone and Android, this website and the TwoWay account service. Contact us at marcos@montalvo.io.

If you get TwoWay from the App Store or Google Play, that store’s terms also apply to your download and purchases. Where they conflict with these terms for a store purchase, the store’s rules win.

Your account

  • You sign in with your email address and a one-time code we send to it. Keep access to that mailbox secure: anyone who can read your email can sign in to your account.
  • An account is for one person. Don’t share it or sign in to someone else’s.
  • You need to be able to make a binding agreement where you live. If you are under the age of majority there, a parent or guardian must agree to these terms for you.
  • You can sign out other devices from Account & plan. Tell us promptly if you think someone else is using your account.

The translation service

  • TwoWay translates spoken conversation between two languages using AI from OpenAI. Your device sends audio directly to OpenAI; TwoWay’s server manages the session. Translations and voices are generated by AI, not by a human interpreter.
  • AI can mishear, mistranslate or invent words, and quality varies by language, accent, device and surroundings. Check anything important with the other person.
  • Don’t rely on TwoWay in emergencies, or for medical, legal, financial, safety or other high-stakes decisions. Use a qualified interpreter or professional for those.
  • The language TwoWay shows for a message is an estimate. It is a label for the text, not an identification of who is speaking.
  • TwoWay needs an internet connection and the microphone permission you choose to give. Pause stops the microphone and the session.

Minute packs and the free trial

  • TwoWay is paid for with conversation minutes. You buy minutes in one-time packs; there is no subscription and nothing renews. Packs will be available to buy in the apps soon.
  • You don’t need an earlier purchase to buy a pack. Pack sizes and prices, including any taxes, are shown before you pay.
  • Purchased pack minutes never expire. They belong to the account that bought them and can’t be moved to another account, resold or exchanged for money, except through a refund described below.
  • Each new account gets one free five-minute trial. Trial minutes expire 30 days after they are added to your account and are used before pack minutes. One trial per person; we may hold a trial for review if it appears to repeat an earlier one, as explained in the privacy notice.
  • Direct purchases in the Android APK and Mac app are processed by Paddle, our payment provider. App Store and Google Play purchases are processed by those stores. We never receive your full card details.

How minutes are counted

  • Live counts the time TwoWay is listening and translating.
  • Push to Translate counts one conversation from your first press that gets a translation until two seconds after the last translated words, including the pauses between exchanges in that conversation.
  • Each successful conversation counts at least 15 seconds. A conversation that produces no translated words is not charged.
  • If a connection reaches its time limit and TwoWay reconnects, the conversation continues as the same conversation, with no second minimum and no charge for the reconnection gap.
  • Your account balance, not the timer in the app, is the record of your minutes. See pricing for details.

Refunds

Our refund page has the full policy. In short:

  • For packs bought directly through Paddle, you can get a full refund within 14 calendar days of purchase if none of that pack’s minutes have been used.
  • For your first paid pack, we also offer one satisfaction refund within 14 days if you have used no more than five of that pack’s minutes. Trial minutes don’t count toward those five.
  • App Store and Google Play purchases follow those stores’ refund processes.
  • An approved refund removes the unused minutes of that pack only.
  • Your mandatory consumer rights, including any right to withdraw or to a remedy for a faulty service, and the app stores’ rules always apply and take priority over this policy.

Acceptable use

Use TwoWay lawfully and respectfully. In particular, don’t:

  • translate or record people without telling them and getting any permission the law requires;
  • use TwoWay to harass, threaten, defraud or harm anyone, or to produce illegal content;
  • try to get around minute counting, trial limits or usage limits, for example by creating accounts to collect repeat trials;
  • interfere with, overload, probe or reverse engineer the service, or access it other than through the TwoWay apps;
  • use TwoWay in a way that breaks OpenAI’s usage policies.

To keep the service reliable, TwoWay applies fair-use and safety limits, such as daily usage limits and a short pause after repeated empty conversations. We may suspend or close an account that breaks these terms or puts the service or other people at risk. Where we can, we’ll tell you why and give you a chance to respond.

You keep any rights you have in what you say. You let us and our providers process it only to run the service, as described in the privacy notice. TwoWay’s apps, website and brand belong to us.

Privacy

The privacy notice explains what TwoWay processes, what is stored and your choices. In short: TwoWay’s server does not save your audio or transcripts, and conversation text stays in app memory until the app closes. You must agree to the in-app AI & Privacy notice before translating.

Ending your account

  • You can delete your account at any time from Account & plan, or by email. See delete your account for the steps and what is kept.
  • Deleting your account forfeits any remaining minutes, including unused pack minutes. If a pack still qualifies for a refund, ask before you delete.
  • If you still have a subscription bought directly through Paddle in an earlier preview, cancel it before deleting your account; TwoWay can’t delete an account while that subscription can still renew. App Store and Google Play subscriptions must be cancelled with the store; deleting your account doesn’t cancel them. Earlier subscriptions otherwise keep their original terms.

Changes and availability

We keep improving TwoWay, so features, supported languages, voices, platforms and AI models can change. The service may sometimes be unavailable because of maintenance, outages or problems with our providers. If we stop offering TwoWay, we will give reasonable notice where we can and handle unused purchased minutes as applicable consumer law requires.

Disclaimers and liability

  • We provide TwoWay with reasonable care and skill. Beyond that, and to the extent the law allows, it is provided “as is”: we don’t promise that every translation will be accurate or that the service will always be available.
  • To the extent the law allows, we are not responsible for losses that come from relying on a translation, for indirect or unforeseeable losses, or for business losses. Otherwise, our total responsibility to you is limited to the amount you paid for TwoWay in the 12 months before the claim.
  • Nothing in these terms limits responsibility that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing here takes away your mandatory rights as a consumer where you live.

Changes to these terms

We may update these terms. We will post the new version here with a new date and, for significant changes, tell you in the app or by email before they take effect. Changes don’t reduce minutes you have already bought. If you don’t agree to new terms, you can stop using TwoWay and delete your account.

Contact

Questions, complaints and requests go to marcos@montalvo.io. Please contact us first so we can try to fix the problem; this doesn’t limit any right you have to go to a consumer body or court. See support for help with the apps.
